in consideration of such Student being permitted to participate in the following activities while attending Yeshivas Bircas HaTorah in Jerusalem, Israel (the “yeshiva”) to wit:
OFF SITE YESHIVA FUNCTIONS, WEEKEND TRIPS, TOURS, HIKES, OUTINGS AND ASSOCIATED TRAVEL (WHETHER OR NOT THESE ACTIVITIES ARE yeshiva SPONSORED AND WHETHER OR NOT THEY OCCUR WHEN yeshiva IS IN SESSION OR DURING VACATION PERIODS AND WHETHER OR NOT THEY ARE IN ISRAEL OR OUTSIDE OF ISRAEL), INDEPENDENTLY LEAVING yeshiva GROUNDS ON yeshiva OR VACATION DAYS, AND ENGAGING IN ATHLETIC, EXERCISE AND/OR FITNESS ACTIVITIES ON OR OFF yeshiva PREMISES, INCLUDING THE USE OF ATHLETIC, EXERCISE AND/OR FITNESS EQUIPMENT ON OR OFF yeshiva PREMISES
do hereby agree to indemnify, protect and hold harmless the yeshiva, its officers, directors, fiduciaries, trustees, supervisors, agents, employees and all private persons volunteering services without charge, and/or the owners of the yeshiva premises and grounds from any claim or liability, including, but not limited to, personal injury, property damage, court costs, attorney's fees and interest, howsoever caused, as a result of participating in the aforesaid activities.
As further consideration for being permitted to participate in the aforesaid activities, I hereby specifically waive any claim or right which might otherwise accrue to us and against Yeshivas Bircas HaTorah, its officers, directors, fiduciaries, trustees, supervisors, agents, employees and all private persons volunteering services without charge, and/or the owners of the yeshiva premises and grounds, as a result of an injury to myself or damage to any of my property resulting from participating in the aforesaid activities.
Any medical and related expenses incurred as a result of such activities are the sole responsibility of myself and my family and are in no way an obligation on Yeshivas Bircas HaTorah. It is my obligation to provide adequate health/dental insurance for my stay at Yeshivas Bircas HaTorah.
The Student and Parents or Guardians agree and acknowledge that all athletic, exercise and fitness activities have the potential to cause personal injury and/or property damage and that the Student and Parents and Guardians assume all risks of injury and damage that may occur as a result of the Student’s participation in such activities. The Student and Parents or Guardians also certify that the Student is physically able to participate in such activities.
This Indemnity Agreement and Waiver of Claims shall not operate as a release of any insurance company insuring any of the Student, his Parents or Guardians, the yeshiva and/or any of its officers, directors, fiduciaries, trustees, supervisors, agents, employees and all private persons volunteering services without charge, and/or the owners of the yeshiva premises and grounds from liability to pay or reimburse any of them in accordance with the terms of any insurance policy issued to cover claims of the character herein before described and that are the subject of this Agreement.
This agreement shall be binding upon all parties herein before designated for the duration of the student’s enrollment with Yeshivas Bircas HaTorah or at any time that the student continues to be involved in any capacity with Yeshivas Bircas HaTorah.
